The Bilingual website (Website) and the application (the App, Bilingual, we or us) and all the features and / or related services (Services) are owned and operated by Appliin – Application Life Innovation S.A.S. Before signing up for Bilingual, it is your responsibility to read these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not sign up for, access or use Bilingual.

Please note that these Terms and Conditions apply at the time you sign up for, access and / or use Bilingual. Likewise, you declare that you have read, understood and agree to be bound by these Terms and Conditions, including any and all kind of modifications they may have in the future. Likewise, Bilingual may and will modify, update or change these Terms and Conditions at any time and will notify you through its website, indicating at the top of the Terms and Conditions page the last update. If you continue using our services after the publication of modifications, changes and / or updates, it will be understood and constitute the acceptance by you of said modifications and / or updates. As a Bilingual user you must have a personal account, in which you declare that all information you provide is legitimate and truthful. Likewise, you must note that if you use the Services of Bilingual on behalf of an entity, person and / or public figure, you declare and guarantee that you are authorized and accept these Terms and Conditions on behalf of the entity, person and / or public persona and also accept that you are and will be solely responsible for the violation of these Terms and Conditions and will respond to any criminal, civil and / or fiscal action.

The inappropriate use of the Services in accordance with these Terms and Conditions may result, among other things, in the suspension and / or termination of your rights of use and may be subject to legal, civil and / or fiscal actions by Bilingual and third parties affected.

For Bilingual, it is very important to keep your privacy secure and all types of information that you provide is and will be subject to our Privacy Policy. Please note that by using Bilingual and its Services, you immediately accept the collection and use of such information in accordance with the provisions of our Privacy Policy. Conditions for Registration and Use of the Account

All users must have the minimum legal age allowed in their countries (18 years for Colombia) to sign up for, access and / or use Bilingual and any of the Services. In order to access the areas and features of our Services, you will need to sign up for an account using your email address.

If you sign up for with your email address, you agree to create a unique password that you do not use with any other online service. By signing up, you also agree to:

(A) Provide proper, truthful, updated and complete information;
(B) Keep and update your account information in the event of any change;
(C) Keep the security of your account by protecting your password and restricting access to any other person, since your account and password are unique and non-transferable;
(D) Promptly notify Bilingual if any breach of security related to the services is discovered or suspected; And
(E) Assume responsibility for all activities that occur in the use of your account and accept all risks of any authorized or unauthorized access.

Likewise, you as a user and all Bilingual users understand and accept that the use of the mobile app as a social network is to interact with others users culturally (based on shared interests) in order to practice, learn and/or teach languages or contact professional services related to languages such as tour guides and/or translators/interpreters. Device Authorization

All users must take into account that in order to make a better use of the application, Bilingual will optionally request access to the device camera, gallery and location. If this access is not authorized, users may continue to use Bilingual. However, the application will not function properly for taking pictures or sharing pictures and/or location. Likewise, Bilingual will only make use of these functions when users make use of them.

Interactions with other users

Our services provide a contact platform for those users who wish to contact and be contacted by other users through the chat. However, Bilingual understands that there is a possibility that you and all users may meet personally for social, tourist and / or educative purposes, which may have an economic compensation depending on the agreement that is established between them. Please note that Bilingual has no reach and will be involved in these agreements, therefore, Bilingual recommends you and all users to have a good judgment and keep safety precautions. Please note that Bilingual only provides the communication channel between you and any of our users and does not have any participation, interest and will not carry out any kind of monitoring in any transaction or communication between two or more users. Likewise, Bilingual does not represent any user or entity. Therefore, Bilingual has no responsibility related to any communication, transaction (s), interaction (s), conflict (s) or any form of relationship between users, persons or entities. Therefore, you and the other users are fully responsible for your and their actions and interactions with other Bilingual users.

Likewise, you and all users understand that Bilingual does not investigate the personal, criminal, legal and / or fiscal background of any of its users when signing up. Therefore, we do not verify the reputation, conduct or morals of any user or any other information that they record on Bilingual.

However, Bilingual reserves the right to carry out any investigation, if necessary, through the public records available or with the competent authorities.

Verification of identity

Please note that you are fully responsible for determining the identity and suitability of others with whom you may interact through Bilingual. Likewise, keep in mind that Bilingual does not declare or guarantee that the information given by users is enough to determine if it is appropriate to guarantee the interaction with another user or other users. Additionally, Bilingual does not represent or sponsor any person or entity that signs up for or uses the services of Bilingual.

Liability release

Please note that Bilingual is a contact platform, in case you have a problem or a dispute with one or more users, to the extent permitted by the law you release us (and our officers, directors, members, employees , agents and affiliates) of claims, legal actions and damages (real or resulting) of any type and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising from or related in any way to this type of problems and / or conflicts.

Please note that Bilingual uses the Internet for its operation, therefore we recommend using it connected to a Wi-Fi network for a better performance. Otherwise, the application will use your mobile data resources and you are and will be solely responsible for the consumption of your mobile data plan and any extra fees that may be charged by your mobile operator and/or internet provider. Take into consideration that Bilingual is not and will not be responsible for any kind of fees incurred by the use of mobile or network data and you are solely responsible for managing and limiting the use of your mobile data on your devices.

User Behavior and Content

Please note that Bilingual has Services that include interactive areas where you or other users may create, share or store content, messages, text, photos, data and information in general. You are solely responsible for the use of these interactive areas and you accept that the use of these interactive areas, is under your own responsibility and risk.

Restrictions of User Content

Please note that you are solely responsible for any content that you send, write or transmit through our Services. You agree not to send text, write, transmit, distribute, store or create through our services content that:

(A) is / is illegal, libelous, defamatory, threatening, invasive of another’s privacy or publicity rights, or otherwise creates civil liability or violates any local, national or international law;
(B) has a sexual or obscene, pornographic, indecent, lewd, suggestive or sexual exploitation content in general;
(C) may disparage any ethnic, racial, sexual or religious group by stereotyped representation or is otherwise abusive or defamatory;
(D) represents the use of illicit drugs;
(E) contains offensive language;
(F) incites violence or characterize violence as acceptable or desirable;
(G) contains private or personal information about another person, unless said person has agreed to the disclosure of said information;
(H) contains viruses, corrupted data or viruses from harmful, detrimental or destructive files, cancel bots, Trojans, harmful codes, flood pings, denial of service attacks, IP spoofing packet, fake routing or email address information or similar methods or technologies or any type of malicious attack that may cause damages to Bilingual and / or third parties;
(I) may infringe any patent, trademark, brand secret, copyright or other intellectual or property right of any party. By creating user content, you represent and guarantee that you have the legal right to distribute and reproduce such user content; or
(J) constitutes, incites or provides instructions for a criminal offense or violate the rights of third parties. Bilingual is not responsible for any user content that you or other users send, write, transmit, share, store or publish through our services.

User Behavior

Please note that by accessing or using Bilingual and its Services, you agree to act in a responsible manner, with good judgment and to comply with these Terms and Conditions and all our policies. Likewise, you agree to the following:

(A) You will not use our Services in violation of any applicable law or regulation, including the promotion or encouragement of any illegal activity;
(B) You will not infringe the rights of third parties, including, without limitation, intellectual property, privacy, publicity or contractual rights;
(C) You will not use the Services in any way that could interfere, interrupt, affect negatively or inhibit that other users may fully enjoy the Services or that may damage, disable, overburden or damage the functioning of all Bilingual Services in any way;
(D) You will not use our services to carry out fraudulent activities, sexting, trade in crypto-currencies or other kinds of currencies;
(E) You will not stalk, intimidate, harass or threaten or cause inconvenience to any other user through our services and / or any subject that has a commercial and / or work relationship with Bilingual;
(F) You will not collect or store information about any other user than the one allowed in our services;
(G) You will not use the Bilingual brand for commercial purposes, unless you have the prior written consent of Bilingual;
(H) You will not sign up for more than one user account;
(I) You will not impersonate another person, entity or falsify or misrepresent yourself or your affiliation with any person or entity, either by providing or omitting information in any other way;
(J) You will not avoid or attempt to break and / or attack security or verification measures related to the use of the Services;
(K) You will not help third parties to carry out any of the above mentioned points.

Suggestions

Separated and apart from user content, we receive questions, comments, suggestions and ideas about Bilingual and our Services. If you provide a suggestion, either by email or any other contact means of Bilingual, you agree that it is not confidential (unless Bilingual states otherwise in writing) and will automatically become wholly owned by Bilingual. Likewise, you understand that Bilingual will own exclusive rights, including all intellectual property rights and you will be entitled to freely use and disseminate the suggestions, comments or ideas for any purpose, commercial or otherwise. Likewise, you acknowledge that Bilingual is not obligated and will not provide recognition or compensation of any kind in exchange for the suggestions, comments or ideas provided by you.

Copyright and Limited License

Unless otherwise indicated, the Services and all content and other materials in the Services, including, without limitation, the Bilingual logo and all designs, texts, graphics, images, videos, information, data, software, sound files and other files, and the selection and arrangement thereof, (collectively, “Bilingual Materials”) are the property of Bilingual and could be protected by Colombian and international copyright laws.

You are granted a limited, non-exclusive and non-limited license to access and use Bilingual Services and Materials; however, said license is subject to these Terms and Conditions and does not include:

(A) any resale or commercial use of the Services or Bilingual Materials;
(B) the distribution, public use or public display of any Bilingual material;
(C) the modification or any other form of uses derived from Bilingual Services and Materials, or any part thereof, unless the modification or derivative use is specifically permitted by applicable law or determined in accordance with the separate terms ;
(D) the use of data mining, robots or similar methods of gathering or extracting information;
(E) the download (other than the page cache) of any part of the Services, Bilingual Materials or any information contained therein, except as expressly permitted in the Services; or
(F) any use of the Services or Bilingual Materials that are not for the intended purposes.

Any use of the Bilingual Services or Materials other than specifically authorized in this document, without the prior written authorization of Bilingual, is strictly prohibited and will revoke the license granted herein. Such unauthorized use may violate applicable laws, including without limitation copyrights and trademarks. Unless expressly stated otherwise, nothing in these Terms and Conditions will be construed as granting any license of intellectual property rights, whether by exclusion, implication or otherwise. This license is revocable at any time.

Copyright Complaints

If you believe that Bilingual or any of the Services infringes any copyright, implying that you are the owner or have control, you may submit a notification through our email .

In addition, you must note that if your notification about Bilingual’s infractions is false or not legally proven, you will be responsible for any damages, including costs and attorneys’ fees, incurred by us or the alleged infringer.

Termination

Please note that if you breach these Terms and Conditions, or any other Bilingual policy, it is possible that, at our discretion at any time:

(A) we suspend access to our Services,
(B) we deactivate or delete your account and all related information in that account.

On the occasion when we believe that it is necessary to protect the safety or well-being of users, we will delete one or more user accounts of our services without prior authorization.

Interruption of services

We may, at our discretion and without liability to you, with or without prior notice and at any time, modify or discontinue, temporarily or permanently, any of the Services of Bilingual.

User Declarations and Guarantees

You declare and guarantee that you have all the power and authority to accept and act under these Terms and Conditions. If you are using our Services on behalf of any entity, you declare and guarantee that you are authorized to accept and act under these Terms and Conditions on behalf of that entity.

You declare and guarantee that you will use our services in a compatible way with any national and international laws.

You declare and guarantee that you will not use Bilingual or any of the Services if the laws of your country prohibit you from doing so in accordance with these Terms and Conditions (for example, if you are not allowed to provide the types of personal information we require or if you are not allowed to participate in certain activities on the Internet). By using the Services of Bilingual, you declare and guarantee that such use will not violate or cause us to violate the laws of your country.

Exclusion of Guarantees

Please note that if you use Bilingual and the Services, you do so at your own risk. Our Services are provided “as is” and “as available.” To the extent permitted by applicable law, we expressly deny, and you waive all other guarantees of any kind, either express or implied, including, but not limited to, guarantees of marketability, fitness for a particular purpose, ownership and non-infringement regarding the Services, including the information, contents and materials contained therein.

We do not declare or guarantee that:

(A) Our services meet your needs;
(B) Our services are uninterrupted, punctual, safe, or free of errors;
(C) Any information you may obtain through our Services is accurate or reliable;
(D) The quality of any service or information obtained by you through our Services is adapted to your expectations;
(E) Any information you provide or that you collect is not disclosed to third parties in accordance with our Privacy Policies, or;
(F) Errors in the data or software are corrected.

Please note that if you access or transmit any content through the use of our Services, you do so at your own discretion and at your own risk. You are solely responsible for any loss or damage arising from such access or transmission. Therefore, you should use an industrial recognition software to detect and disinfect viruses from any download.

Any data, information or advice obtained by you orally or in writing from us or through our Services will create any guarantee that is not expressly stated in these Terms and Conditions.

Bad Behavior

If you interact with someone through our Services and feel that that person is acting or has acted inappropriately, including but not limited to offensive, violent or sexually inappropriate behavior, or has stolen from you or engaged in any other disruptive behavior or illegal, we recommend that you immediately inform the competent authorities and contact us immediately through our communication channels. Please note that although we recommend reporting bad behavior, we are not responsible for the actions of our users and we are not obligated to take any action.

Notifications by Bilingual

Please note that by using Bilingual and the Services, you agree that we may communicate with you through your account and / or by other means (push notifications, email, text messages, WhatsApp, third-party app chats that are managed by Bilingual). Therefore, we recommend you to read our Privacy Policy and also the configuration of your accounts linked to Bilingual Services and / or the configuration of your mobile phone, in this way, you will have control over the messages you want to receive by Bilingual. Likewise, note that by making full use of Bilingual and the Services of the application, you accept that we may carry out and notify all types of information related to Bilingual and its Services through marketing and publicity campaigns.
